Terms and Conditions for Therapy Insights Practice

Effective Date: September 17th, 2024

Welcome to Therapy Insights Practice! We are committed to providing high-quality, trauma-informed, skill-based psychotherapy services to individuals, couples, families, and communities, including the LGBTQIA community. By accessing our services—whether in-office, virtual, or through telehealth—you agree to these Terms and Conditions.

1. Acceptance of Terms

By accessing or using the services provided by Therapy Insights Practice, LLC ("Therapy Insights Practice," “we,” or “us”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these terms, you are not authorized to use our services.

2. Services Provided

Therapy Insights Practice offers psychotherapy services utilizing evidence-based modalities such as Cognitive Behavioral Therapy (CBT), Dialectical Behavior Therapy (DBT), Eye Movement Desensitization and Reprocessing (EMDR), Emotionally Focused Therapy (EFT), Solution-Focused Brief Therapy (SFBT), and others. These services are designed to address mental health issues such as trauma, anxiety, depression, and relationship challenges. Our clinicians are licensed professionals committed to providing personalized treatment plans tailored to each client’s unique needs.

Note: Therapy Insights Practice is not a crisis intervention service. In the event of a mental health emergency, please call 911 or visit the nearest emergency room.

3. No Guarantee of Outcomes

While our clinicians strive to deliver effective therapeutic interventions, Therapy Insights Practice makes no guarantees regarding the specific outcomes of therapy. The success of therapy is dependent on many factors, including client participation, the nature of the issue, and the therapeutic alliance.

4. Confidentiality and HIPAA Compliance

Therapy Insights Practice takes client privacy seriously. All client information is handled in compliance with the Health Insurance Portability and Accountability Act (HIPAA) and all relevant federal and state laws governing patient confidentiality. We use SimplePractice, a HIPAA-compliant platform, to manage telehealth sessions, scheduling, and billing. Your personal health information will not be shared with third parties without your written consent, except where required by law (e.g., mandatory reporting of abuse, imminent harm to self or others).

5. Supervisory Billing and Clinician Supervision

At Therapy Insights Practice, we believe in the importance of continuous professional development. Many of our clinicians may operate under the supervision of licensed professionals as part of their path to full licensure. This means:

  • Supervisory Billing: If services are provided by a clinician under supervision, the billing may reflect the supervisor’s name and credentials until the clinician is fully credentialed by insurance providers(Clinical Supervision Co…)(Supervisory Contract (1)). This ensures that our services are covered by your insurance while maintaining high standards of care.

  • Clinician Supervision: Our supervisors provide oversight, guidance, and feedback on therapeutic interventions to ensure compliance with ethical and legal standards. Supervision is essential to maintaining the quality of care and ensuring adherence to CPT, ICD-10, and DSM coding standards for accurate billing and treatment(Supervisory Contract (1)).

All client information discussed during supervision remains confidential and is protected by HIPAA regulations.

6. Payment and Insurance

Therapy Insights Practice accepts a wide range of insurance providers, including Aetna, Blue Cross Blue Shield, United Healthcare, Optum, Oxford, UMR, Oscar, Medicare, and MagnaCare. We also offer out-of-network and self-pay options. It is the client’s responsibility to verify insurance coverage and understand their financial obligations for services, including any co-pays, deductibles, or uncovered fees. Payment must be made prior to or at the time of service.

7. Cancellation and No-Show Policy

We ask for 24-hour notice if you need to cancel or reschedule an appointment. Failure to provide adequate notice or missing an appointment without notice will result in a cancellation fee, which will be charged to your account.

8. Client Responsibilities

As a client, you agree to:

  • Actively participate in your treatment plan.

  • Provide accurate, up-to-date personal and medical information.

  • Adhere to the mutually agreed-upon treatment goals and strategies.

  • Attend scheduled appointments or provide 24-hour notice for cancellations.

Failure to comply with these responsibilities may impact the efficacy of your treatment and could result in the termination of services.

9. Telehealth Services

We offer telehealth therapy sessions via our HIPAA-compliant platform, SimplePractice. Telehealth allows you to receive therapy from the comfort of your home, but it is your responsibility to ensure a private, quiet space for these sessions. You must also have a stable internet connection for effective communication during the session. While telehealth is highly convenient, it may not be suitable for all clients, and we reserve the right to determine the appropriateness of telehealth on a case-by-case basis.

10. Limitation of Liability

Therapy Insights Practice provides psychotherapy services on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind regarding the completeness, accuracy, or efficacy of our services. We are not liable for any damages arising out of or related to your use of our services, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

11. Termination of Services

Either party may terminate the therapy relationship at any time. Therapy Insights Practice reserves the right to terminate services if it is determined that we cannot meet your needs, you fail to adhere to these terms, or for any other reasons we deem appropriate. Upon termination, we will provide referrals to alternative mental health professionals if needed.

12. Dispute Resolution, Choice of Law, and Arbitration

This Agreement and any disputes arising from your use of our services will be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

Any disputes arising out of or related to these terms or the use of our services shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). Both parties waive the right to a trial by jury or participation in a class action lawsuit.

13. Updates to Terms and Conditions

Therapy Insights Practice reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of the services constitutes acceptance of the modified terms.
